DEED OF TRUST

Between Joseph Marr/William Marr & William R. Utter

A legal document was found in Monroe Co book of deeds or indentures in the Court house which gives a snapshot of the life in 1830's and ties William and Joseph together in their younger years A verbatim wording of the "Indenture" with all of its archaic legal language follows where the exquisite hand scripted document could be deciphered:

"This indenture made this sixth day of January one thousand and eight hundred and thirty four between William Utter of the _____ and Joseph and William Marr ___ all of the county of Monroe, state of Tennessee. Witness that whereas the said Joseph & William Marr are indebted to William K. Utter in the sum of two hundred and seventy five dollars which may be discharged in good live pork and good merchantable whiskey. Pork at three dollars per cwt and whiskey at 331/3 cents per gallon together with the feeding of thirty five hogs; therefore in consideration of one dollar paid by Robert R. Young to Joseph & William Marr to _____ in _____ by the said Robert R. Young the receipt whereof is hereby acknowledged that the said Joseph & William Marr doth grant & file and convey To Robert R. Young the following property to _______ _______ _____ between fifty and sixty hogs, the still and vessels, mill stones and crows for tub mill together with another pair of millstones and two hundred bushels\par of good sound corn, all the property of Joseph and William Marr as the above mentioned shall be vested to Robert R. Young for the benefit of William R. Utter. Now if the said Joseph & William Marr doth will and truly pay the above mentioned sum unto the said William R. Utter due at the above mention time with all legal cost that may accrue therein touching the above mentioned payments. In case the said Joseph & William should make a default in payment of the about to hundred and seventy five dollars in port and Whiskey as above _____ to the said William R. Utter as bound those the said Robert R. Young by the request of William R. Utter, the Robert R. Young after giving ten days legal notice to Joseph and William Marr of the above County of the time and place for the payment, then Robert R. Young shall sell the property for ready money as will satisfy the above debt. William Marr(seal) Joseph Marr (seal), Test: Arthur Orr, Davies Marrs (x=his mark) registered 10 Jan 1834.
