In the 1995 gubernatorial race one of the candidates for governor made this statement about the state of Louisiana:
"Louisiana is last in everything it should be first in, and first in everything it should be last in."On July 6, 2000, the Louisiana Supreme Court showed the world just how backwards and primitive Louisiana really is. The state Supreme Court upheld Louisiana's anti-sodomy laws, and in the process took the state's constitution and wiped their behinds with it, before flushing it down the toilet. What was even more shocking were the comments made in the majority opinion. Here are a couple of statements from the majority opinion:
"Simply put, commission of what the Legislature determines as an immoral act, even if consensual and private, is an injury against society itself".
"A violation of the criminal law of this state is not justified as an element of the 'liberty' and 'privacy' guaranteed by this state's constitution." (Personal comment: Since when does a constitutional guarantee need further justification?)In short, the five Nazis for Jesus (NFJ), who delivered the majority opinion have decreed that the Louisiana Legislature is now the supreme authority on morality, even extending into the bedroom of every man, woman and child in Louisiana. This, in spite of the fact that the Louisiana constitution has an explicit privacy clause!
The constitutionality of state statutes is supposed to be judged against what the constitution says. This is so in every state of the Union, except in Louisiana. In Louisiana, the Legislature can override the state constitution with a statute! So says the Louisiana Supreme Court. In fact, according to the Louisiana Supreme Court, the privacy clause of the state constitution takes second place to Legislature whim, and does not extend to the bedroom! In keeping the anti-sodomy statutes and tossing out the Louisiana constitution's privacy protections, the Louisiana Supreme Court has literally destoryed privacy in Louisiana. Afterall, if there is no privacy in the bedroom, then where the hell is it?? What does privacy even mean?
What Louisiana's Supreme Court did is pure Christian Reconstructionist idealism at its uglyist and most frightening. Privacy, especially in the bedroom, is the biggest enemy for the Nazis for Jesus. With privacy, much of the NFJ agenda cannot be implemented. Yesterday, the Louisiana Supreme Court declared war on privacy, and in the process, gave the NFJ's a great victory.
July 6, 2000 will be a day long remembered in both Louisiana and the rest of the United States. It was the day Louisiana's Supreme Court both embarrassed and shamed Louisiana in the eyes of the world. As the rest of world strives to recognize freedom and privacy as two inalienable rights that all human beings possess, Louisiana just flushed these two rights down the toilet. Why would anyone who cherishes freedom and privacy want to move to this awful, vile state? If the state's highest Judges won't protect privacy, then who will?
