n.1: The current percentage of schools offering a state civil procedure course is 40%. A number of California schools have ......added state civil procedure to their curricula in the last year, preseumably in response to the Oct. 17, 2002 notice that this ......subject will be tested on the state bar exam.
n.2:
Additional clinical education details are available at <http://www.cleaweb.org>. One must thereon navigate through
......each individual school's website to access details, including whether there is a web-based database for each school's .....clinical/internship/externship opportunities. This STATE CIVIL PROCEDURE SURVEY, as it evolves, is designed to ultimately .....provide only each school's clinical website information. It currently provides ready access on one webpage--regarding
......state.civil procedure and clinical courses--for all ABA-accredited law schools. The author has relied upon direct imput
......from faculty members, rather than the sometimes outdated information available on various websites. The responses
......remain anonymous, unless otherwise requested. Any mistakes regarding such faculty input is solely that of the survey
......author. Please provide notice of any changes regarding either your school's state civil procedure or clinical offerings ......(preferably only a.clinical/intern or externship website) to <bills@tjsl.edu>.
n.3:
Years ago, offered a course on Florida civil procedure.
n.4: Team litigation projects when offered as 3-unit course. No skills component when offered in the 2-unit summer class.
n.5: Two units, with 3rd optional skills unit until 1997. The lack of accreditation authorization for online courses resulted in .....dropping this online unit. The ABA promulgated its initial cyber course guidelines in 2001.
n.6: Because we are less than a half hour from the Georgia border and have a number of students who commute from Georgia, ......we have offered a course in Georgia Civil Procedure in the past. The frequency is not that clear. But, it is a.course that we ......offered at some time within the last two years.
n.7: Interviewing & counseling negotiation--two-thirds state & one-third fed. It is also taught in Pre-Trial.
n.8: State Civ. Pro. is taught as part of our 6 hours of required Civil Procedure (Civ. Pro I & II).
n.9: About half is Kansas civil procedure.
n.10: Our 1st year civil procedure course focuses on Indiana civil procedure, with some reference to the Federal Rules. Also, ........principles of Indiana civil procedure are taught as part of the various civil clinics we have here. Indiana civil procedure is.
.........
on the Indiana bar.
n.11: Students take a course called "Clinic" and get experience with a variety of cases.
n.12: We probably should teach Ohio Prac & Proc, but no one has time to develop the course.
n.13: It is the subject of an entire section of the Louisiana Bar exam and has become the most difficult to pass.
n.14: I once taught an independent study to a student who was returning to my home state of Missouri. I doubt whether this
........has happened very often.
n.15: Although many waive into DC and/or have ties to VA.
n.16: Either in house or conjunction with another local law school.
n.17: I also offer a review session on Massachusetts Civil Practice, every June, as an aid to our graduates--prior to their .......beginning their commercial bar review courses.
n.18: Pre-requisite for some of our clinic offerings and concentrates on Missouri (and some Illinois) discovery and practice ........information.
n.19: Although NH has not adopted the FRCP (we still use the writ system and law and equity have separate procedures), in ........reality the practice in NH state court is not all that different from federal court. Most practitioners use the same form.of ........pleadings and motions they would use in federal court while enjoying the benefits of the far less managerial bench that.
........
they.find in the state courts.
n.20: Rutgers Newark lists both NJ practice and NY practice in its catalogue, but that doesn't mean they're actually given.
n.21: Selected Problems in New York Civil Practice.
n.22: First year is a six credit Civ Pro federal rules class. Because of [offering] NY Practice, we tend to stay away
....... from any.NY law except the long-arm statute.
n.23: We offer a year-long, 3-credit New York Practice course & a one-semester, 2-credit adjunct-taught version.
n.24: In the past we offered New York procedure (for maybe a couple of years) since we might have a dozen or so students ....... per year who intend to go to, or return to New York.
n.25: Even though there are not enough differences to create a meaty course on Okla. Civ Pro, the bar examiners often pick ....... those areas of difference to emphasize on the bar exam * * * according to my colleague who teaches the Civ Pro ....... ....... component of the Okla. Bar Review. I also review the questions, and it varies by year, but some years I think he is ....... ....... definitely correct.
n.26: Offers PA Criminal Procedure.
n.27: We have a variety of courses connected with our litigation certificate program that focus on practice before state ........(ie,Pennsylvania) and federal courts. These courses cover both rules and so-called practical issues.
n.28: In the past we have offered NJ Civil Practice, but the recent demand has been too low to justify the offering.
n.29: Required: All students intending to practice in Texas must take these courses.
n.30: The Law Clinic is both a credit course and a functioning law office, allowing students to practice law while in lawschool. ........Students represent indigent clients in court under direct faculty supervision. A classroom component meets.weekly to ........study.the substantive law, to learn essential practical skills, and to discuss client cases.
n.31: Discussed WVA, KY, and TN because of number of students who migrate--although they ted to follow fed.
n.32: I do not think that large numbers of students take this course even though Virginia procedure is tested extensively on the ........bar exam (25% of the state portion). Virginia does not follow the FRCP but retains a modified version of the common
.........law system of procedure. (It retains the distinction between law and equity, for example, with different procedural rules ........and deadlines for each.) 25 years ago, I opted not to take the course because I was told that the bar review course
.........would teach me all I need to know about Va. procedure--which was more or less true (Gordon Hylton).
n.33: Part of the reason for this advanced course is that the Civil Procedure faculty created it when CP changed, from a
.........2-semester 6-credit course, to a 1-semester 4-credit course. We couldn't bear the thought of our students (or at least
.........those who plan on trial practice) missing out on so much. It's been a successful course (Shirley Wiegand).
