Unlike litigation or arbitration where decisions are made by judges or arbitrators, mediation is a process that helps the parties exchange information through facilitated negotiation. Most civil cases can be mediated. Mediation allows the parties to play an active part in the resolution.

    . . . the mediator is a neutral third party who assists the parties in attempting to resolve their issues. The mediator provides a neutral environment, a process to keep the parties focused, and helps the parties explore and understand their interests, needs, risks and options.
