Here is an article sent to us by William Morgan.  It was written by Mark Andrews and is entitled, "Were Two of Orange County's Founding Fathers at Odds?".  This article appeared in The Orlando Sentinel on April 12, 1998 on page K-2.

 

Without a doubt, two of Orange County's most important pioneers were Aaron Jernigan and Judge James G. Speer.

Jernigan made the first homestead claim inside the present borders of Orange County in 1843. Speer played important roles in getting the county seat moved to what is now Orlando, giving the city that name and arranging for the donation of land for the first courthouse in the new town.

What is not known is how--or even whether--these two men interacted.

Jernigan was a cattleman and an Indian fighter, a Georgia native who moved his family and herds here when no one--literally no one else--lived within 18 or 20 miles. He helped start the first church here, and was Orange County's first representative in the state Legislature. But, he was a rough-and-tumble frontiersman who was more at home on horseback. His service as a captain in the Florida Mounted Militia led to allegations of brutality against the Seminoles, though he was cleared by the governor's investigation.

Speer, on the other hand, was a polished political figure, a lawyer, and later a probate judge who negotiated land deals with businessmen. He served as chairman of the County Commission and as a state legislator, and he ran unsuccessfully for the U.S. Senate and governor. As founder of the west Orange town of Oakland, then an important farming community, he arranged for a new railroad to be routed through there.

Reading between the lines of history, it appears that as Jernigan's star was fading in the mid-1850's, Speer's was rising.

Some Jernigan descendants say that was no accident.

Talk within part of the family for decades--even generations--has been that Speer was jealous of Jernigan's position in the community and wanted to push him aside. Carol Stewart, a great-great-granddaughter of Jernigan who lives near Mount Dora, recalls her grandfather, Robert Lee Jernigan, (Jernigan's grandson) telling her that Spear tried in several ways to discredit Jernigan so he could become the founding father of his own town.

"They don't give him credit for anything, and that hurts me," Stewart said of Jernigan. "Judge Speer had a vendetta against [Jernigan] . . . He changed the town's name to Orlando. He said my great-great-grandfather killed Indians that didn't need to be killed . . . And, Speer cheated him out of a lot of land."

Stewart acknowledges there are no historical records to support these allegations. "It's only what the family has talked about."

This much is known: In the early 1850's, Jernigan was constantly in trouble with the law. He was in court almost every time the circuit-riding judge came to town, because he owed people money and once was convicted of assault. Jernigan's neighbors complained to the governor in 1852 that he had stolen 120 Seminole hogs and killed four natives. Jernigan also fell into disrepute when his oldest son stabbed a man to death, and the two of them escaped from jail in Ocala.

If the name Jernigan was bringing a black eye to Orange County, Speer may have found little opposition when he moved in 1856 to give the name "Orlando" rather than "Jernigan" to the settlement that had just won a referendum to become the county seat.

But, was Speer a rival of Jernigan?

Jack H. Ross, a west Orange citrus grower who is a great-great-grandson of Speer, said he has never heard any such talk in his family. Kay Stone of Lakeland, who is descended from a Georgia branch of the Jernigan family and has done considerable research on the clan, also said she has heard of no rivalry with Speer.

Furthermore, it's unlikely that Speer was involved in complaining to the governor about Jernigan's treatment of the Seminoles, because that incident occurred in early 1852. Speer didn't move to Orange County until 1854. (Gov. Thomas Brown sent an Army major general here in February-March 1852 to conduct an inquiry into Jernigan's conduct, but found no evidence against him.)

Brenda J. Elliott of Kissimmee, a historical researcher who has done considerable work on the life of Jernigan, pointed out that there was never really a community here with the name Jernigan. So, the name change to Orlando didn't really steal from his legacy. In the mid-1850's, there was not so much as a village because settlers lived on tracts of at least 160 acres, so their homes were widely separated.

It is true that the first post office in what is now Orlando was established by Jernigan in May 1850--and the name "Jernigan" even appears on one map produced in 1855. But, others called the settlement Fort Gatlin after the nearby Army stockade.

"You're always going to have squeaky wheels. People were jealous," Elliott said last month, adding that she has turned up no evidence of a rivalry with Speer. "But, Jernigan was definitely the choice of the people in the county who sent him to the Legislature . . . He had what it took. He had the political connections."

In a 1994 interview, Elliott added this about Jernigan: "He came to Florida a very prominent person from Georgia. His reputation in Georgia was that he was very reliable . . . If we put aside political correctness and look at conditions [in which he lived], I think he was a pretty outstanding person. He really was the anchor of this community. To me, he's a hero."

Regimental Descriptive Book: age: 43, ht. 5'6'', dark complexion, blue eyes, brown hair, born in Bertie Co, NC enlisted 12/1/63 in Plymouth by Capt Johnson, for 3 years.

Died at Andersonville, Ga July 1864.

In the Name of God Amen the 9th day of may 1736 I Henery Jernigin of the presint of Bertie in the County of Albemarle in North Carolina planter being very Sick and weak in body but of perfect mind and memory Thanks be given to god therefore calling to mind the mortality of my body and knowing that it is appointed for all men once to die doe make and ordanee this my Last will and testament that is to say principaly and first of all I give and recommend my soul into the hands of god who gave it and my body I recommend to the earth to be buried in Christian burial at the Discretion of my Executor nothing doubting but at the general resurection I Shall recover the same again by the mighty power of god and as to touching such worldly estate where with it hath pleased god to bless me in this life I give dismiss and dispose of the same in the following manner and form

Imprimis I give and bequeth to Phoebe my Dearly beloved wife a hundred and forty acors of land lying at Cashi that I bought of henery overstreet and William Jones and the bed that She now has and one new Sheet and one quilt and one rug.

Item I give and bequeath to my well beloved Son Henery Jernigin and his heirs, eighty acors of land more or less it being the plantation he now lives on beginning at a pine Joseph Blackmans Corner thence along a line of marked trees to a white oak a line and aft tree of John Blackmans. I also give to him and his heirs my negro woman Rose and her Increas from this time forward and two cows and calves and one ewe and lamb

Item I give to henery Dubbons his freedom upon previsor he discharges me of a suit of clothes I owe to him at his fredom I also give him that bed he now lies on and the furniture on his ________ clothes and a hundred acors of land to him and his heirs being part of a tract of land at cashi of my son Jacob his part of a sertin black hors that he now has and two sows and pigs.

Inprimis I give and bequeath to my well beloved wife phebe my four saddle horses and all my movable estate with in and with out to her proper use except the cattle and Sheep and them to be divided between my wife and my son Jesse and my Son dempsie when Jesse is sixteen years old each an equal Shear also to my wife I give the use of my negero man roben four year and then to return to my son Jacob and his heirs forever

Item I give and bequeath to my Son well beloved son henery Jarnigin whom I make and ordain my executor of this my last will and testament all my lands mesuage and tennament belong to him Somerton Creek on the north side in Virginia

I also desire that my wife and my son Jacob may have the use of my sons Dempsie plantation till he comes to the age of sixteen

I also make constitute and ordain my well beloved son Jacob Jernigin executor with his brother henery and I hereby utterly disalow revoke and _____ all and every other former testaments wills legasies and bequests and executors named willed and bequeathed ratifying this and confirming this to be my last will and testament witness whereof I have hereunto set my hand and Seal this day of May 1736 enter and before assiged and sealed

Family Notes:

James Randolph Jernigan served in the Confederate States Army during the Civil War. Thomas "Tom" Lawrence was working for James Duncan "Boss" Conner when John William Thomas (my grandfather), husband of Martha Frances Jernigan, killed "Boss" Conner at the Thomas Place. At the time of the killing, Amanda Jernigan had not married Thomas Lawrence. James H. "Jim" Jernigan was a handicapped boy and was killed in the early 1900's in a log train accident near Ayden, NC. He tried to jump from one log car to another and fell between the cars and was killed.

Jackie Ryskamp is posting some names of people who had dealings with her William(?) Holloman back in NC. in the hopes that someone, somewhere has a bible or whatever that will help her.  Looking for HOLLOMAN who was the father of Judith Jernigan, married to Ryan O. Jernigan, son of Samuel Jernigan.  There is also a Miles H. Jernigan whose will  I've seen and now cannot find.  Other names connected to both Hollomans and Jernigans are RICHARD ARNOLD, NATHAN MIERS (SP?), WILLIAM AND EDWARD OUTLAW. These folks lived around Ahoskie Swamp, Bertie Co. NC from 1720 to around 1800. Any connection may help!  You can email Jackie or write to her at R#1 Box 1854; Baldwin, MI. 49304.

Jernigan Updates

Has there been a birth, wedding, death, etc in your family?  Or perhaps you are about to publish a book or have heard about one of interest to Jernigan researchers.  Let us know and we'll announce it here.

March 29th marked the 35th anniversary and retirement of Pastor Arvie Fern Jernigan from Lakeland Street Baptist Church in Fort Worth, TX.  Dr. Jernigan was honored by friends, family, and colleagues in special services and at a reception at the church.

Arvie is a descendant of Elisha Jernigan and Zilpha Gibbs of NC, the great grandson of Calvin Jernigan and Susan Bardin, and the grandson of Fern Jernigan and Lillie Bell Luman.

For those of you who are still looking for your ancestors who were in the Confederate forces during the Civil War, here is a really helpful book called In Search of Your Confederate Ancestors.  This is a really super guide to census records; state archives and even the official records to the Civil War.  It's a pretty quick read and well organized.

Reunions

The Dunn, NC Jernigan reunion is as always on the first Sunday of May which happens to be May 3rd this year. It will be at 12:30pm at the Stoney Run Church which is on Hwy 55E, 3 miles East of Dunn.  However, if you plan to go you'll want to arrive early as there is an added attraction this year.  Marion Hargrove, who many of you will remember wrote the preface to Lillian Worley's book, Jernigan Reunion, will be honored at a library in NC for donating his works to it. Marion's "dedication" ceremony is Sat, May 2 at 2:00 p.m. at the Mt Olive, North Carolina library.  As Marion lives in CA, this may be your only chance to meet him if you are on the East coast!  Please plan to attend this reunion.  I know that I'll be there!

There will be a Jernigan Reunion of the descendants of Samuel Jernigan of Bertie Co.,  NC in Aulander, NC at the Aulander Community Building on Saturday, June 20, 1998.  It will start at 12:00 noon and last until 3:00pm. Bring food & drinks for your family and visit for awhile!

Reba Powers sends us news of a Jernigan Reunion in Shelby County, TX.  It is a reunion for descendants of Calvin Jernigan and Susan Bardin scheduled for July 11/12, 1998.  Reba writes that she already has confirmations from every branch of this family with eight states represented so far! Put it on your calendar. This promises to be a blast!  It will be held at the Pinecreek Lodge in Nacogdoches, TX.  Each guest room has a kingsize bed, refrigerator, TV/VCR, and extra rollaway beds available upon request. Resort amenities include: driving range, basketball, volleyball, two fishing holes, one swimming pool, two hot tubs and horseshoes.

The cabins are spread throughout a beautiful pine thicket. The creek is so pretty.  And there are lots of wooden stairs, decks, porches, porch swings, rocking chairs. You will love the environment! Be sure and bring your camera; this place is a photographer's dream.

Editor's Note

This month has come and gone so fast that my head is still spinning!  As usual, things have been hectic around the Boots household.  Sometimes I don't know whether I'm coming or going but I always try to ask when I pass myself! 

I'm sure that you have noticed the new full-colored coat of arms.  That is compliments of Helen Jernigan.  She gave me permission to use her colorized version.  Thanks Helen!

The Jernigan Homepage has had another baby!  Check out the new homepage called "The Jernigan Bookshelf"! This is a list of books on the Jernigans. If you have anthing to add to it or are willing to do lookups, let me know.  I'm very excited about this site.  I think that it will be a great help to all of us.  Now we will have one place to go to see what publications there are on the Jernigan family.  Many thanks go to Sharon Tingley and Barbara Fowler for their work on putting this page together.  Kudos Ladies!

I'm still working on adding a counter to the bottom of the homepage.  Some of you have been curious as to how many people actually visit this homepage.  And I have to admit, I am curious as well.  I hope to figure this out by next month.

Cyndi won another scholarship from the local music society.  We haven't quite figured out what she will do with it yet. With our schedule this summer, I'm not sure we can fit in a music camp!  We may just put it into her college fund.  She also turned professional this month.  She got her first paid job as a pianist.  She accompanied some band members at school for a competition.  She was so excited when she found out that she would get paid! And the band members she helped received a superior rating!

Krystal's softball team is still doing well.  They have a 7-2 record.  Her playing has really improved this year. This past Saturday, she slid in to home base for the first time. (Thank goodness for black pants!  It shows off that orange South Carolina clay so well!) She also had several hits, one of which was a beautiful hit right down through center field!

The girls and I went with my parents to spend Easter vacation in Myrtle Beach.  We had a wonderful time. There certainly is no lack of entertainment of any kind in that area! We returned home the Friday before Easter. Saturday was spent at my grandmother's house for my cousin's daughter and son's birthday party.  They aren't twins, they just have birthdays close together.  Easter was very quiet!  We basically stayed at home and relaxed! It was wonderful!

We went to Plymouth, NC for a civil war reenactment in the middle of April.  We had a great time.  If you live near there, you ought to go and watch this event next year.  This battle involved land and sea troops. It also had an eclectic group of soldiers which included Loyal NC (Union) troops and some black troops.  There were Jernigans there on both side of the battle.  If you are interested, let me know and I can send you info on the battle for next year.

My foot is all better now.  I am walking around like nothing happened.  The surgeon has declared me good as new. I do not regret having surgery on it one bit.  Walking without pain is wonderful!

NetIntent, the company for which I am working,  offered me a partnership.  So, I now own a third of the company. This is definitely a new experience for me!  But I am excited about the prospects and am looking forward to helping develop this company to its fullest extent.

So much is coming up next month!  (It never slows down here!)  I am getting ready to go to the Dunn reunion.  I am looking forward to meeting Marion Hargrove - something I thought I'd never get to do.  We are also planning on doing some research at Raleigh if anyone has any requests!  Also, if you plan on going to that reunion, email me and let me know. Look for a report on the Dunn reunion in the next edition.  I'm sure there will be some tales to tell!

I'm getting long-winded so the rest of next month's plans will simply have to wait until the next editorial.  There ought to be some surprises! Have a wonderful May.
