The Will of Wade Slaton I

On 11th of March 1861, Jackson County, Georgia Will Book B (1860-1880), page 100,

In the Name of God, Amen, I Wade Slaton of Jackson County, Georgia being of advanced age and knowing that I must shortly depart this life deem it right and proper both as repects my family and myself that I should make a disposition of the remaining property with which a kind providence has blessed me do therefore make this my last will and testament revoking all others heretofore made by me.

1st, I desire and direct that my body be buried in a decent and christian like manner suitable to my conditions in life my soul I first shall return to rest with God who gave it as I hope for eternal salvation through the merits and atonement of the blessed Lord and Savior Jesus Christ.

2nd, I desire and direct that all my just debts be paid without delay by my executors appointed...

3rd, I desire what money is left after paying all my just debts all my property...including negros Winny, Sarah, Janie, Peter, Wisly, Adalun, George, Jeremiah, John, Lucy, George, Martha, William, Mark, David, Joseph, to my beloved wife, Mary Slaton, which she shall have during her natural life.

4th, I desire after the death of my wife, Mary Slaten that my friend W W Hinton shall have my negro boy Peter and the remainder of my negroes, land and stock...be sold at the highest bidder by my executors hereafter appointed and the money equally divided amoung the following named persons:

Sister Milly Smith,
Brother, William Slaten,
Littleberry Slaten,
Elizabeth Posey,
Usley Key,
Mary Elrod,
Mickey Slaton,
Philip Elrod,
Samuel Elrod,
George G Elrod,
Elizabeth Elrod,
Susan Lewis, and
Frances Moore.

5th, I desire after the death of my sister Mickey Slaton 1, the portion of money she gets of my estate shall be given to her son, William Slaton.

6th I hereby consitute and appoint my friends W W Hinton and M F Hinton, executors of this my last will and testament.

Notes:

1I have not seen the actual book this was copied from and this is obviously John Slayton's transcription. It would appear that this transcription errs when it designates Mickey as Wade Hampton's sister. In an Abstract of Wills, Georgia DAR, compiled by Mrs. H. W. Smith, Sunberry Chapter, it states:

In the will of Wade Hampton Slaten I, dated 3/18/1861, in Jackson Co, GA and probated 2/21/1865, he names wife Mary; sisters Mary Elrod, Elizabeth Elrod, Susan Leives, Frances Moore, Milly Smith, Elizabeth Posey, and Ulsey Key; and brothers, William Slaten, L. Melbury Slaten and Mickey Slaten; nephews, Phil, Samuel, and George Elrod.

Additionally Mickey Slaton's will, dated 9/21/1865, probated 6/3/1872, names sons William (b. 1812, Pendleton, SC) and Gibson Slaten (b. 1809, Pendleton District, SC; d. 1882, Athens, Clarke, GA) and a descendant named Charles Slaton of Covington, GA, (son of Gibson Slaton) confirms that Mickey is definitely male.
