Will of Jesse Weaver, 14 January, 1834.

In the name of God Amen, I Jesse Weaver of Hertford County and State of North Carolina in the year of our Lord Eighteen Hundred and thirty four January the 14 Being of sound mind and memory thanks be given unto God for the same knowing that it is appointed for all men must die. I do make and ordain this my last will and Testament that is to say viz I give unto my beloved wife one third part of the money that my Lands sell for and will also and I give unto her one cow and one mair (mare) and one bed and furniture and she is to have the use of the house and Land's untill sold and my part of the tall corn to be for the use of the family untill the Mill is Sold. The other part of the tall corn my two sons is to have for keeping the Mill. I lend unto my daughter Fanny Cotton one bed & furniture for her use and her children. I lend unto my daughter Nany Cottom one bed & furniture for her use and her children. I lend unto my daughter Phebe Cotton one bed and furniture for her use and her children. I lend unto my son William one bed & furniture for the use of him and his family. I lend unto my son Jesse wood one bed & furniture for the use of him and family. I lend unto my daughter Martha one bed and furniture for her use as long as she lives. I lend unto Mary Flood one bed and furniture for her use as long as she lives and I leave my two sons Executors to my Last will and testament and I leave all my land and Mill to be sold at publick or private Sale as they may think best and after my wife gets one third part then the balance to be equally divided among my children namely my son William and my son Jesse wood and my daughter Fanny and my daughter Naney and my daughter Pheba and my daughter Martha but I give unto my two sons first one hundred dollars more than the rest and I do hereby appoint my two sons my executors this my last will and testament and the said Jesse Weaver doth revoke all wills and this and no other to be my last will and testament in writing whereof I the said Jesse Weaver doth here unto set my hand and seal the day and date above written and signed sealed and delivered in (illegible).

This last will & testament of Jesse Weaver decd. was in open court proved by the oath of Obed Copeland , one of the subscribing witnefes thereto & ordered to be Recorded. At the same time William Weaver sworn one of the executors thus is appointed was duly qualified as such & payed & obtained an order for letters testamontary thereon

In the name of God Amen I William Weaver of Hertford County and State of North Carolina being weak in body but of sound mind and memory thanks the almighty God for the laws but calling to mind the mentality of life natures and that it is appointed for all must once to die do make & ordain this my last will and Testament in manner following that is to Say___
First I give and bequeath my life to the hand of Almighty God who gain is hoping for acceptance with him through the mercies of our Lord Jesus Christ and my body to be decently buried at the discretion of my Executors here after named and my worldly Estate as following
Item 1st. I leave to my beloved wife Anny Weaver during her natural life or widowhood the plantation wherein I now live containing Sixty Acres, at her death or marriage to be equally divided between my two sons Lawrence & Eli Hugh Weaver to them and their heirs forever.
Item 2nd. I give and bequeath to my son Edward one half the plantation called the old place containing fifty acres & the other half I give to my daughter Angeline my daughter Milly & my grandson William Alford Weaver to be divided equally between the three provided they give to my beloved wife one fifth part of the profit arising off of said land during her natural life or widowhood to them and their heirs forever.
Item 3rd- I give and bequeath to my two sons John & Willis Weaver the plantaion called the Buzzle place that is to say they shall give to my beloved wife Anny one fifth part of the corn is made on the land every year during her natural life or widowhood then to them and their heirs forever.
Item 4th. I give to my daughter Jenny Hall five Shillings to be paid by Executors to her and her heirs forever.
Item 5th I give to my daughter Feby Williamson five shillings to her and her heirs forever.
Item 6th I want all my property not given away after paying all my just debts to be equally divided between my wife and my five sons Lawqrence, Hugh, John, Willis, & Edward to them and their heirs forever.
Item 7th I appoint my son Lawrence Weaver Executor to this my last will and Testament this given under my hand & seal

Hertford County Sessions November Term 1844
This last will and testament of William Weaver decd. was exhibited in open court at this Term for probate,and the dere execution of the law proved by the oath of Costen Jordan one of the subscribers witnessed thereto is appearing satisfactorily to the Court that Kinsey Jordan the other subscribing witness to said will is dead whereupon the said will was ordered to be recorded.
