Residents have the right [42 U.S.C. §1396r(c)(2)(A)] to remain in the nursing facility unless:

  • transfer/discharge is needed to meet the resident’s needs and facility cannot meet these needs;

  • the resident’s condition has improved and no longer requires facility treatment;

  • the safety of the resident or others is endangered;

  • the resident failed to pay, after reasonable notice; or

  • where the facility closes.
