appointment of Milton McNabb as Guardian of Margaret McNabb, aged 17 years

Margaret Jane Kyle's Will
Be it remembered that on the 11 day of December 1866, the last will and
testament of Margaret Jane Kyle deceased late of Miami County Ohio was
filed in the Probate Court of Miami County Ohio, proved the will and
testimony ordered to be recorded which will and testimony and probate is
in the words and figures following to wit:
In the name of the Benevolent Father of All, I, Margaret Jane Kyle, of
the County of Miami and state of Ohio, do make and publish the following
as my last will and testament, that is to say:
Item 1. I do hereby request my executor hereinafter named, to pay all my
just debts and funeral expenses, out of any money or personal property
that may be on hand at the time of my decease.
Item 2nd. I devise and bequeath unto my beloved Mother Sarah McNabb
during her natural life the house and lot in Troy, in which I now life
unless she (my mother) and my Executor, shall deem it best to sell the
said house and lot and buy one less expensive, in which case, I hereby
fully authorize and empower my executor, to sell and convey the same; and
the money obtained, for the difference in said property, shall be put at
interest or in Bonds, and the interest shall be paid to my mother yearly
or semi-yearly (as it may suit best) during her natural life. Item 3rd. I
also devise and bequeath unto my mother all the personal property
contained in my house at the time of my decease for the like period.
Item 4. I bequeath unto my Executor, in Trust, my gold watch and chain,
the same to be sold by him at my decease, and he to put the money on
interest until my two sons Walter and Thomas Kyle arrive at age
respectively and the said money then to be divided equally between them.
Item 5. I devise and bequeath unto my said mother Sarah McNabb the one
third of the net proceeds of my farm situated in Staunton Township Miami
County, Ohio, during her natural life provided she does not have her
dower assigned therein. It hereby being my intention to give her the
above in lieu of her dower interest therein as the widow of my father
A.W. McNabb, and if she should think best to have her dower assigned
therein, then,this clause of my will to be void. Item 6th. I devise and
bequeath unto my children, Walter, Thomas, Cordelia, and Iva Kyle, all of
my real estate, personal property (except that disposed of in the former
part of this will) to share and share alike. Item 7th. I do hereby
nominate and appoint Samuel K. Harter, Guardian of my two sons Walter,
and Thomas Kyle, to remain such until they respectively arrive at age.
Item 8. I do hereby nominate and appoint David Kelly of said county, the
Executor of this my last will and testament. In testimony whereof I have
hereunto set my hand this 14th day of November A.D. 1866.
