Rowan County, NC Records Regarding Nicholas Beaver

  1. Book 9 page 53: July 1, 1779, The State grants (#26 at 50 shillings the 100 acres) Coddle and Templetons Mill Creeks to Jennet Kennedy 400 acres net John Lowery, crossing Mill Creek Three times, next __ Huston, Hugh Parks & __ Jamison. (DAVID CHERRY NOTE: The land that Nicholas sold to Jacob was part of this tract! See # 6 below. I cannot find the deed from Alexander Penny to Nicholas Beaver!) This reference is from McCubbins.
  2. Book 9 page 106: on Sept. 13, 1779, John Cochran, a planter of Rowan County, NC, lets Nichlis Bever have a tract on both sides of Cold Water Creek "the waters of Rockey River, joyning James Woods & Andrew Cochran", 250 acres beginning on the east side, for 2000 pounds NC money, witnessed by Griffith Rutherford & ? & proved by General Rutherford in Feb. Term of 1780. Reference is made in the Rowan County court minutes to this transaction. Rowan County, NC Vacant Land Entries 1778-1789 abstracted by Richard A. Enoch in 1988 gives the following. #2163 John Coughran 100 A. on waters of Coldwater and adj Andrew Coughran, Samuel Coughran and Hugh Gollihar. Made over to Nicholas Beaver
  3. Nicles Bever is listed on the "1784 Rowan County Tax List of Capt. Richard Graham." He had 350 acres of land and 2 white polls. (Rowan County, North Carolina Tax Lists 1757-1800, Annotated Transcriptions, Page 225, Jo White Linn, 1995.)
  4. Nicholas Beaver was selected for jury duty in August of 1791 according to the Rowan County court minutes. A further reference shows that he was part of the Grandjury as of August 1, 1791.
  5. Nicholas Beaver is listed on the "1796 Rowan County Taxt List of Andrew Bostian's Company." He had 350 acres and 2 white polls. (Linn, page 331)
  6. From McCubbins: Book 22 pages 653-654 (also 553-554 which are sticken out): Jan 27,1800 Ncholas Beaver (a German and no wife signs) of Rowan C., NC lets Jacob Beaver also of Rowan, have 215 acres on Coddle Creek & Templeton's Mill Creek next to John Park & John Leazer for 140 pounds, witnessed by ? and Jacob Shuping & proved by the latter in Feb. 1813. (This land had been granted to Jane Kennedy then to Alexander Penny and then to the said Nicholas Beaver).
  7. Other deed references for Nicholas include several in 1817 to his sons Dawalt/David and John.
    1. Book 28 pages 163-164: 11-20-1817 Nicholas Beaver of the County of Rowan in the state of North Carolina of the one part sold 49 acres of land on the east side of Coldwater Creek.to John Beaver of the County of Rowan and state of North Carolina of the other part. The land was sold for and in consideration of the sum of one hundred dollars. This deed was "duly proven in open Court by the Oath of Jacob Shuping, recorded and ordered to be registered" in February 1825
    2. Book 28 pages 523-525: 9-24-1817 Nicholas Beaver of the County of Rowan in the state of North Carolina of the one part sold 142 acres of land on Coldwater to Dawalt Bever of the County of Rowan and state of North Carolina of the other part. The land was sold for and in consideration of the sum of four hundred dollars. This deed was "duly proven in open Court by the Oath of Jacob Shuping, recorded and ordered to be registered" in May 1826.
    3. Book 28 pages 525-527: 11-12-1817 Nicholas Bever of the County of Rowan in the state of North Carolina of the one part sold 204 acres of land on Coldwater to John Bever of the County of Rowan and state of North Carolina of the other part. The land was sold for and in consideration of the sum of five hundred dollars. This deed was "duly proven in open Court by the Oath of Jacob Shuping, recorded and ordered to be registered" in May 1826.
    4. Book 28 pages 540-542: 1-8-1823 Nicholas Beaver of the County of Rowan in the state of North Carolina of the one part sold 49 acres of land on Coldwater Creek to his son David Beaver of the County of Rowan and state of North Carolina of the other part. This land was sold for and in consideration of the sum of one hundred dollars. This deed was "duly proven in open Court by the Oath of Jacob Shuping, recorded and ordered to be registered" in May 1826.
  8. The will of Nicholas is found in Book H on page 344. It was probated at the May Session 1826. The will is as follows:
    In the name of God Amen. I Nicholas Beaver of the County of Rowan and State of North Carolina being of a sound and perfect mind and memory. (blesset be to God.) do this fourth day of September in the year of our Lord one thousand eight hundred and twenty make and publish this my last will and testament in manner following that viz, Seventhly (?) I give and bequeath to my son Johnsharis the remainder of that half of my personal estate that David and John gets after the have paid my daughter Christena Secondly Igive and bequeath to my beloved son David Beaver the lands that John A(?) ran off for him; I give and bequeath the half of my person estate to my two sons David Beaver and John Beaver I give and bequeath the other half of my personal estate to Davids and Michael Beaver's heirs. Thirdly I give and bequeath my beloved son Jacob Beaver besides the land already in his possession and the sum of ten shillings Fourthly I give and bequeath to my beloved son John Beaver the plantation where on he now lives and the other forty eight acres on the east side of the water of Cold water Fifthly I give and bequeath to my beloved son Michael Beaver besides the land already in his possession my rife gun and house clock Sixthly I give and bequeath the sum of forty pounds one half to be paid by my son David Beaver and the other half by my son John Beaver and I do hereby make and ordain my worthy friends Jacob Shuping Jun and David Beaver my son executors of this my last will and testament. In witness where of the said Nicholas Beaver have set unto my hand and seal this day and year above mentioned. The will was signed sealed published by the said Nicholas Beaver the testator as his last will and testament in presence of us who were present at the the time of signing and sealing thereof.   9. Nicholas was also a soldier in the Revolutionary War from Rowan County, NC. Roster of Soldiers from North Carolina in the American Revolution published first in 1932 and republished in 1967 and 1972 by Genealogical Publishing Co., Inc. at Baltimore gives on page 210 the following reference. "Comptroller's Office Vouchers" No. 2424 Nicholas Beaver, Salisbury Dist.
  10. The following deed references to Nicholas were taken from Abstracts of Deed Books by James W. Kluttz, 1996. There are three volumes in this series and I have used all three. I have also just given the references to show Nicholas as owner and/or adjacent property owner or witness. I have not chosen to give the other adjoining property owners or witnesses in most cases.

  11. Census records of Rowan County give:
    1. 1790 Nicholas Bever 3 males over 16, 2 males under 16, and 3 females
    2. *1800 Nicholas Beaver 1 male 10-16, 1 male 16-26, 1 male over 45, 1 female 10-16, 1 female 16-26, 1 female over 45.
    3. 1810 Nicholas Beaver 1 male over 45 and 1 female over 45. (I have rationalized that this is Nicholas and his daughter Christena.)
    4. Nicholas is not listed in the 1820 census and may have been living with family members or the census taker may have missed him. (More census analysis is needed at this point.)
    *Another Nicholas Beaver is found in the 1800 census. He is found on the same page as Peter Beaver. I have no explanation as to who he is. This is the only time that he shows up in any record. He was aged 26-45 with a male 0-10 and a female 16-26 in his household. The other Nicholas above was in the area where he should have been!
  12. There are also references in the Organ Lutheran Church Records for Nicholas.
    1. John Nicholas Beaver subscribed his name to the nine regulations listed in the church records and date 1-1-1789.
    2. Nicholas Beiber & w were sponsors at the baptism of Mary Eliz. Braucher a daughter of John Braucher on 4-3-1791.
    3. Nich Biber & w were sponsors at the baptism of Elizabeth a daughter of Dewalt Biber. This was their son and granddaughter.

Notes on Averhart Smith / Eberhardt Schmidt / Schmitt

I believe that Nicholas Beaver and Eberhart Schmitt were brothers-in-law. They each married a daughter of Johannes Scheuer. Eberhart Schmitt probably preceeded Nicholas Beaver in the move to Rowan County from Pennsylvania.

  1. Eberhart Schmitt came to America on the ship Edinburg, September 14 1753. He was confirmed in Hirschland, Alsace Lorraine in 1742. Records of Saarwerden county office for Hirschland: Dated 21 Jan. 1761: Eberhard Schmidt has been in America since 9 years. Rev. Daniel Schumacher's records in Pennsylvania give: Margreth Schmidth, wife of Eberhardt Schmidth, sp. a child of Michael Biber in Weisenberg in 1763. Eberhard Smidth and Margaretha, in name of their daughter Christina, as parents, were sp. in 1773 for a child of Henrich Katterer in Bern twp. Weisenberg Lutheran KB, Lehigh co: Eberhardt Smidt, elder of the Lutheran congregation, m. 19 Sept. 1758 Margaretha Scheurer, old Johannes Scheurer's single daughter. Eberhard Schmidt, elder of the Luther congregation, and wife Margaretha had: Johnaa Dewaldt bp. 1 Jan. 1761 3 days old Sp: Dewalt Keppele and Elizabeth Scheuer, single. Christina b 5 Feb. 1764. bp 12 Feb. 1764 Sp.: Johann Nicholas Biber and Barbara, wife of Michael Bieber. ENDNOTES

  1. Dates are taken from the records of Mamie McCubbins, famed Rowan County genealogist, with a change from me. She probably copied these from the original gravestone at Mt. Zion. Nicholas' gravestone has not been visible in my years (30+) of searching. Mrs. McCubbins' notes say, "In Mt. Zion graveyard, China Grove, N.C. is: "R O. N O R. Necol's Bever He was 3 of Fepuary Born 1740 Eage 85 years and 1 month 10 day He die 13 March" the rest is sunken too deeply in the ground to read." Nicholas will was made in 1820 and probated in May of 1826. Note also above #7b, 7c and 7d. Those deeds were proved and recorded in May of 1826. It seems that Nicholas was probably aged 86 and not 85 or else he was born in 1741. I have chosen to think that he was born in 1740 and died in 1826. Why would the family have not had the will probated for over a year after Nicholas'death? The stone was probably not very legible at the time of the reading and a "5" and a "6" can be misconstrued one as the other.
  2. An assumption has been made about the parents of Nicholas. This assumption is based on extant information that has been collected over thirty-plus years of research. Rev. I. M. Beaver in The Bieber--Beaver Family that he published in 1939 on page 922 says that Nicholaus was a son of Lorentz. It is unclear to me at this point if this is I. M. Beaver's assumption or if the records he quoted gave this information. This would be another chink in the armor if the original records do give this information!
  3. Marriage to Anna Elizabeth Scheuer, father-in-law, date and place are taken from Marriages & Marriage Evidence in Pennsylvania German Churches page 456 and from Eighteenth Century Emigrants from The Northern Alsace to America page 64. It is also interesting that Eberhardt Schmidt married 19 September 1758 to Margaretha Scheurer the daughter of Johannes Scheurer. Eberhardt Schmidt was an elder in Weisenberg Lutheran Church. Eberhardt came to Rowan County also and settled near Nicholas Beaver. Eberhardt may have been the father-in-law of George Ketner (Linda Beaver Cherry's first Ketner ancestor in Rowan County.). Extensive Ketner family research has been done. I published a book in 1969 on the Rowan County Ketner family and much research was done by others after that. No definitive answers as to the Rowan ancestors have been found. Ensuing research has greatly narrowed the possibilities. Further researching the Ketner family may or may not provide any further information on the Ketner/Schmidt/Beaver connection. (See Everhart Smith records given above. It is most interesting to note the deeds dated 4-25-1796. Was Everhart settling his estate? No will or other estate settlement can be found.)
  4. The death date for Anna Elizabeth was taken from "The Account Book of Pastor Storch" by Ute-Ingrid Seidler. Pastor Storch recorded, "Bieber, Nic., wife buried 18 November 1803."
  5. Christina has been identified in several ways.
    1. She is named as a child in her father's will. Nothing else is known of Christina in North Carolina. She may have been the female aged 45+ living with Nicholas in 1810.
    2. Rev. I. M. Beaver lists her as child of Nicholas and Anna Elizabeth on page 922 of The Bieber--Beaver Family that he published in 1939.
    3. Annette Kunselman Burgert in Eighteenth Century Emigrants from The Northern Alsace to America page 64 also gives the same record as I. M. Beaver.

  6. Catherine has been identified in several ways
    1. Rev. I. M. Beaver lists her as child of Nicholas on page 922 of The Bieber--Beaver Family that he published in 1939.
    2. Annette Kunselman Burgert in Eighteenth Century Emigrants from The Northern Alsace to America page 64 also gives the same record as I. M. Beaver.
    3. Storch in "The Account Book of Pastor Storch" translated by Ute-Ingrid Seidler recorded the confirmation of two Catharina Bieber's at the Irish Settlement in 1791. One most assuredly would have been the daughter of Nicholas and the other would have been the daughter of Henry. This is the church that the families of Nicholas and Henry were associated with.
    4. The records of Organ Lutheran Church give Catherine Beaver and Peter Ketner as the sponsors at the baptism of Catherine Beaver (4-29-1795). Catherine was most likely the aunt of the Catherine being baptized. The child being baptized was the daughter of Dawalt Beaver, son of Nicholas. The minister at the time sometimes included the notation "&w" between the names of the sponsors. This is taken to mean "and wife." The notation is missing for this record. It seems possible that Catherine may have been the wife of Peter Ketner.
    5. No mention is made of Catherine in her father's will.

  7. Dawalt has been identified in several ways.
    1. He is named as a child in his father's will.
    2. He is listed in the 1850 census of Rowan County, NC. He shows to have been born in Pennsylvania. The reading is as follows:

    3. Rev. I. M. Beaver lists Johann Theobald/Dawalt (In many cases the name Theobald in North Carolina became Dawalt and these names are used interchangeably) as child of Nicholas on page 922 of The Bieber--Beaver Family that he published in 1939. It is strange that Burgert did not include him in her list!

  8. Jacob has been identified in several different ways.
    1. He is named in his father's will.
    2. Rev. I. M. Beaver lists him as child of Nicholas on page 922 of The Bieber--Beaver Family that he published in 1939.
    3. Annette Kunselman Burgert in Eighteenth Century Emigrants from The Northern Alsace to America page 64 also gives the same record as I. M. Beaver.
    4. There was in my years of research an extant tombstone for Jacob! Alas, there were no dates on it! He is buried at St. Enoch Lutheran Church in Rowan County. The Tombstone only contained his name. My strong and on going lament has been, "Oh that the stone would have contained a birthdate." It disappeared some years ago. The census records bear out a correct age for Jacob.

  9. Anna Maria has been identified in several ways.
    1. Annette Kunselman Burgert in Eighteenth Century Emigrants from The Northern Alsace to America page 64 gives Anna Maria as a child of Nicholas.
    2. Storch in "The Account Book of Pastor Storch" by Ute-Ingrid Seidler give two records in regards to Maria.
      1. Maria was confirmed at the Irish Settlement Church in 1791. A second confirmation. was for Maria Magdalena. She was the daughter of Henry Beaver.
      2. Maria (Mary is the name given in the county records.) was married to Johnathan Hartsell on 3-6-1795 by Rev. Storch. Maria Magdalena was married to Daniel Rumple on 9-11-1792. The fact that Daniel Rumple travelled to Ohio with Henry Beaver and other members of his family is further confirmation of the right placement for Maria (ie Anna Maria).
    ***Note!!! It has been a great puzzle for me to figure a placement for Anna Maria (Mary Beaver Hartsell). The placement as a daughter of Nicholas remains somewhat tenuous in my mind. She is not named in her father's will and none of the Hartsell family is either! There were descendants of Johnathan and Mary. I have present day descendants of Nicholas in my records who trace ancestry back to Johnathan and Mary. A volume has been published on the Hartsell family. A cursory look has proved nothing in regards to the parentage of Mary Beaver Hartsell. She was probably deceased by the time that Nicholas died. This could explain the fact that she is not mentioned in his will.
  10. John A. Beaver has been identified in several ways.
    1. He is named as a child in his father's will.
    2. He is buried at Mt. Zion United Church of Christ where Nicholas was buried. Nicholas' grave is probably very close to where John and members of his family are buried. John's tombstone was still extant a little more than ten years ago. It is now gone. His wife's, sons', and one of his daughter's tombstones are still visible.
    3. 1850 census of Rowan County confirms the age given on the tombstone. The census of 1850 is as follows:

  11. Michael has been identified in several ways.
    1. He is named in his father's will.
    2. The Rowan County Census of 1850 confirms a proper age for Michael. The census reading is as follows.
