INVESTMENT GENIUS BREEDING CONTRACT

This breeding contract is made this ______ day of __________, 20__, between Joan M. Winsor and the W/W Ranch, herein after designated the stallion owner, and mare owner/lessee, herein after designated the mare owner.

The mare owner requests service by the W/W stallion Investment Genius, TWH registration # 897478, sired by Pride's Genius, out of H.F. Midnight Easter, standing at the W/W Ranch, Sequim, Washington, for his/her mare, TWH registration #(s), for the 200__ breeding season.  (Use attachment if multiple mares; include papers.)

The service fee for the above stallion is $________, to be paid as follows:   $50 booking fee [non-refundable] with the signed contract, $____ prior to the shipment of semen (non-refundable), or with delivery to the W/W of the mare to be bred, $____ due when the mare is documented safe in foal, unless otherwise agreed upon by both the stallion and mare owners in advance as follows:

The stallion owner agrees:
Semen will be shipped within 24 hours of notification of the mare owner's need for semen. (This is a maximum time, very rarely required to arrange transportation.)  The collection, processing and shipping will be done with the utmost concern for time and cleanliness possible with modern techniques.  The stallion owner will provide a minimum of 1 billion progressively motile sperm per bag. Every effort will be made to provide three bags per shipment, with a minimum of two.

If the mare is to be bred on the W/W premises, she will be provided safe facilities, and cared for and fed in a good and husband-like manner. Veterinary and farrier assistance will be sought in a timely manner when deemed necessary by the stallion owner or designates. A conscientious effort will be made to impregnate the mare in a timely fashion. Reasonable attempts will be made to contact the mare owner in the case of an emergency.  The mare owner will not be held responsible for disease, accident or injury to other horses on the ranch, including the breeding stallion.  Prior to October 15 of the breeding year, a record of the service will be provided to the TWHBEA, guaranteeing that the foal can be registered with the TWHBEA.

The mare owner agrees:
For the purposes of insemination by transported semen, experienced and competent veterinary assistance will be engaged to insure that the mare is in good general and reproductive health, that she is cycling or is cycled with as much accuracy as possible, and that she is inseminated as close to ovulation as possible.  All applicable fees and expenses related to collection of the stallion and shipment of the semen are the responsibility of the mare owner. 

If the mare is delivered [or delivery arranged] to the W/W Ranch, she will be in good flesh, good general and reproductive health, and have a negative Coggins certificate if not of local origin. The following vaccinations will be current: tetanus, Eastern and Western equine encephalitis [EWEE], Potomac fever, flu, and rhino. Strangles is encouraged.  The mare will have been wormed within the previous three weeks with Ivermectin. 

The mare owner will pay the following for on premises care on or before the first of the month: _____/day (dry)  $_____/day (wet).  Late charges will be subject to 18% interest. He/she will be responsible for all veterinary and farrier expenses incurred in properly caring for the above mare (and foal). 

The stallion owner will not be held responsible for injury, illness, or other untoward events involving the mare and/or her foal (if any), including the death of either or both.  The stallion owner will be supplied with a copy of the mare's registration papers prior to shipment of semen or the mare's arrival at the ranch.  The stallion owner will be notified within 7 days of the birth of a live foal or within 72 hours of the loss of the foal at birth. 

Additional conditions:
This contract must be completed in full and appropriate fees paid prior to shipment of semen or to delivery of the mare.  This contract is non-transferable, and is invalid 14 months from the date of signing.  This contract is null and void upon the occasion of the death or incapacitation of the stallion.  

Live foal guarantee:
If within 90 days the mare has failed to conceive, after consultation with the mare owner, a veterinarian will examine the mare, and depending on the advice given, the mare will be rebred or a substitute mare served. This guarantee is valid for the current breeding season, and the following year.  Failure to carry or produce a live foal is to be evidenced by a written statement from a qualified veterinarian.  Abortion for no obvious reason in the last half of the pregnancy requires veterinary documentation of appropriate Rhinopneumonitis vaccination at 4,6,8 and 10 months (or 5, 7 and 9)  to validate the live foal guarantee.  Knowingly allowing twins to be carried beyond 16 days voids the LFG.  A "live foal" is defined as a foal that is able to stand and nurse or is hand-fed for a period of 72 hours.  In the event of failure to produce a live foal the stallion owner agrees to rebreed the mare in the current or following breeding season.  The shipping, veterinary, farrier and boarding expenses for re-breeding will be borne by the mare owner.
