BOARD OF DIRECTORS MEETING

At 6:10, the BoD meeting was called to order by Tom Base

 

The minutes of the September 29th BoD meeting were reviewed and approved 3/3

 

No residents were present for Good and Welfare discussions

 

The President’s report was given by Tom Base.

For Safety and security, the Coral Springs crime report showed no activity in the HHE area.

Fortress, the new security company, is an improvement - no guards have been reported to be sleeping.

 

The Treasurer’s report was given by Jay Nelson

Period ending September 30th

Cash on hand – operating $68,574.63 (as of Oct 30)

Reserves - $20,860.24

Late fees - $10,675 - 35 HO due

Performance to budget - $8,634.35 unfavorable

Year to Date - $3,444.38 favorable. $34k favorable with the starting base for 2003.

Delinquent payment list reviewed with actions

 

Finance Projects:

2004 Budget to be finalized Nov 17

Monitor sprinkler water conversion project payback

Transponder project 67% 400 transponders

 

Legal Report

Three addresses have actions. A HO's 16month payment plan was changed to 6 months. A 90 day notice to be sent.

New By-Laws written and presented to the Board

Land covenant written and presented to the Board

Pre-litigation agreement letter to homeowners drafted and presented to the Board

 


The new Fining notice draft was presented and reviewed. The procedure was discussed.

The HOA was the right to issue a Fining notice for violations including speeding, property upkeep,….

A HO can identify an incidence by reporting it to the BenchMark or the BoD

The BoD decide if it is credible. If so it is passed to the Grievance Committee

The Grievance Committee reviews the violation independent of the BoD. The GC can assesses the payment of a fine of up to $50 per incidence against the HO for the violation. An incidence could be once per day times 14 days. The fine is automatic to start after 14 days. But the HO has the right to go before the GC within 14 days.

The Grievance Committee is Ron Ritter, Mike Smith, and Joe Palador. Mike Smith was approved by 3/3 to replace Lisa Smith

The GC members were OK with the procedure

3 of 3 must be at the GC meeting. A motion requires 2/3 to pass. The GC will meet monthly.

This fining procedure must be given public notice e.g. the next Newsletter or a special mailing.

 

Property Management Report

Violations same as last month

The GC should view the offending property before the review meeting

Melissa will get digital pictures

 

An amendment to the Fortress contract from Robert Kay was presented by Tom B, reviewed, and approved by 3/3

 

Transponders are at 67% from 59%

 

Gate repair expenses were reviewed. These were thought to be excessive and never ending.

 

Mailbox policy was presented by Melissa and reviewed.

Additions were suggested: ' Plumb and level'; Numbers description, part number, and dimensions; Glass black paint. The policy was approved 3/3

 

Speed bumps – make similar to Newport “ California Speed Bump”

Palm Coast is out; PC increase to $23k for '04 from $18k for '03
